General Terms of Service (TOS) of PAMIRIA WEB LTD

Preamble

These general terms and conditions of sale (GTC) govern the contractual relationships between the company PAMIRIA WEB LTD, whose registered office is located at 167-169 Great Portland Street, London W1W 5PF United Kingdom, registered under number 15629796 and whose VAT number is GB468492248, and any natural or legal person (hereinafter referred to as "the client") wishing to use the services offered by the website "https://scan-car.com".

Article 1 - Purpose

These TOS aim to define the terms and conditions of use of the services provided by the website "scan-car.com". The services offered are:

• Vehicle history report
• Cerfas form filling service for administrative procedures related to vehicles
• Estimation of registration card cost
• Detailed administrative status certificate
• 10 Crit'Air sticker requests per month
• Order electronic vignettes for Switzerland

Article 2 - Acceptance of the TOS

Using the services of "scan-car.com" implies full acceptance of these TOS by the Client. The Client acknowledges having read and fully accepted these TOS before using the services.

Article 3 - Description of Services

3.1 Vehicle history report

The vehicle history report provides detailed information about a vehicle's history, including any accidents, repairs, and previous owners.

3.2 Cerfas form filling service

The cerfas form filling service simplifies the administrative procedures related to vehicles by filling out the necessary forms for the Client.

3.3 Registration card cost estimation

This service allows for an estimation of the cost of a vehicle's registration card based on the information provided by the Client.

3.4 Detailed administrative status certificate

The detailed administrative status certificate provides information on a vehicle's administrative status (pledge, opposition, etc.).

3.5 Crit'Air sticker request

The Crit'Air sticker request service allows the environmental sticker necessary to circulate in certain zones to be ordered.

3.6 Sale of electronic vignette for Switzerland

Scan Car acts as an order intermediary with the competent authorities in Switzerland for the processing of electronic vignettes. The Client is solely responsible for the accuracy of the information provided. Any error in the entered data cannot be refunded after processing.

Article 4 - Use of services

The client agrees to use the services of "scan-car.com" in accordance with the laws and regulations in force and with these TOS. Any abusive or fraudulent use of the services may result in the suspension or termination of the client's access to the services.

Article 5 - Subscription and Payment Terms

5.1 Subscription offer

"scan-car.com" offers a monthly subscription at the price of 39€/month, preceded by a 48-hour trial period at the price of 1.29€.

By ordering a Swiss vignette, the Client expressly agrees to activate the associated monthly subscription. There is no free trial period, nor the possibility to purchase only the vignette without subscribing to the subscription.

5.2 Trial period

The 48-hour trial period is charged at 1.29€. At the end of this period, the monthly subscription is automatically activated at the rate of 39€, unless canceled by the Client.

5.3 Renewal and termination

The subscription is automatically renewable each month. The Client can cancel their subscription at any time via their personal account on the "scan-car.com" site.

5.4 Payment terms

Payment for services and subscription is made by credit card (Master Card, Visa and Carte bleue) via a secure payment platform. The Client authorizes the company PAMIRIA WEB LTD to debit the amount of the monthly subscription until its termination.

Article 6 - Right of withdrawal

In accordance with applicable laws, the right of withdrawal cannot be exercised for contracts for the provision of services fully executed before the end of the withdrawal period and whose execution began after the consumer's express prior agreement and express waiver of their right of withdrawal.

By subscribing to one of our services, the client agrees that the execution of the service begins immediately and thus waives their right of withdrawal.

Article 7 - Liability

7.1 PAMIRIA WEB LTD undertakes to provide the services with all due care and diligence. However, PAMIRIA WEB LTD cannot be held liable for any indirect damage suffered by the client, such as loss of data, loss of profit, or any other damage resulting from the use of the services.

7.2 However, within the limits permitted by law, the subscriber is informed that the services and content are provided by the company as is, as transmitted by its suppliers, without any guarantee regarding their availability or accuracy. Thus, the company provides no guarantee and has no obligation to verify the content provided by its partners and/or disseminated on the website.

7.3 In any case, the subscriber acknowledges that some content may contain errors and/or be outdated and accepts a certain margin of inaccuracy. He also agrees that some content may be posted on the website after its official publication date. The company cannot be held responsible for these facts.

7.4 The subscriber must always inquire directly with the competent official and administrative services. Consequently, the subscriber agrees to read carefully the warnings displayed when accessing or consulting the services. It is the subscriber's responsibility to verify the accuracy of the content before using it.

7.5 The subscriber is solely responsible for the interpretation and use of the content, particularly regarding the consequences of its use, analysis, interpretation, and dissemination by himself, and for any inaccuracies, errors, obsolescence, or omissions present in the content. The content is provided for informational purposes only and does not guarantee certainty; its purpose is simply to guide the subscriber in his analyses or personal procedures. The subscriber releases the company from any liability regarding the consequences of this use.

7.6 It is the subscriber's responsibility to ensure that the use of the content complies with current regulations. Thus, the subscriber agrees not to use the content and/or contact data in violation of applicable law, particularly regarding the regulation on the protection of individuals with regard to the processing of personal data and the free movement of such data.

7.7 PAMIRIA WEB LTD cannot be held responsible in case of error in the information entered by the Client (license plate, vehicle category, etc.). The Client is required to verify that the vignette is properly registered before driving on the relevant roads.

Article 8 - Intellectual Property

8.1 Ownership of content

All elements present on the "scan-car.com" website, including but not limited to text, images, logos, graphics, videos, sounds, animations, software, and databases, are protected by international intellectual property laws. These elements are the exclusive property of PAMIRIA WEB LTD.

8.2 Usage rights

The client is authorized to use the services and content of the "scan-car.com" website exclusively for personal use and within the framework of the services offered. Any other use, including reproduction, distribution, modification, adaptation, retransmission, or publication, even partially, of the various elements is strictly prohibited without the prior written consent of PAMIRIA WEB LTD.

8.3 Trademark protection

The trademarks, logos, domain names, and other distinctive signs present on the "scan-car.com" website are the exclusive property of PAMIRIA WEB LTD. Any reproduction or use of these trademarks without prior authorization is strictly prohibited.

8.4 Content provided by the Client

The client guarantees that they hold all the necessary rights to the content they may provide within the framework of the use of the services. The client grants PAMIRIA WEB LTD a non-exclusive, free, worldwide license for the legal duration of intellectual property rights, allowing it to use, reproduce, display, adapt, modify, distribute, and publish the content provided, within the framework of operating the services.

8.5 Respect for intellectual property rights

PAMIRIA WEB LTD reserves the right to remove any content that violates the intellectual property rights of third parties. The client agrees to immediately notify PAMIRIA WEB LTD of any intellectual property rights violations of which they become aware.

Article 9 - Personal Data Protection

The information collected on the "scan-car.com" website is necessary for the management of services and subscriptions. In accordance with the French Data Protection Act ("Informatique et Libertés"), the client has the right to access, rectify, and delete their personal data.

Article 10 - Modification of the TOS

PAMIRIA WEB LTD reserves the right to modify these TOS at any time. The changes will apply as soon as they are posted on the "scan-car.com" website. It is the client's responsibility to regularly review the TOS to be aware of any modifications.

Article 11 - Applicable Law and Jurisdiction

These GTC are subject to English law. In case of dispute, the parties agree to seek an amicable solution before taking the dispute to the competent courts of London.
